Summary Conviction Offences

Licensed paralegals may act as legal counsel for summary conviction offences punishable by no more than jail time of two years less a day and/or a $5,000 fine. Examples of such offences include but are not limited to:

• Theft under $5,000
• Trespassing at night
• Stopping or Impeding Traffic
• Failure to Remain at the Scene of an Accident
• Identity Theft
• Assault

Some offences are known as hybrid offences. This means the Crown may elect to proceed summarily, but may choose to charge as an indictable offence as well. A paralegal cannot represent you for a hybrid offence unless the Crown has elected to proceed summarily.

The cost of representation for a criminal offence is billed hourly at $60/hour + 13% HST. The cap on this cost is $3,000 + 13% HST.
